Terms and Conditions (Submitting orders for applicants)
By using the elysium44.ae website (the “Site” or “Elysium44”) or by using or purchasing any services on this Site, you hereby expressly agree to follow and be bound by these terms and conditions (the “Terms”) and agree to comply with all applicable laws and regulations.
In these Terms, the words “you”, “your” and “I” refer to each client, Site visitor, “we”, “us” and “our” refer to Elysium44 and “Services” refer to all services provided by us.
It is your responsibility to review these Terms periodically. If at any time you find these Terms unacceptable or if you do not agree to these Terms, please do not use this Site or any Services. We may revise these Terms at any time without notice to you.
YOU AGREE THAT BY USING THE SITE, ANY APPLICATIONS, AND THE SERVICES YOU ARE AT LEAST 21 YEARS OF AGE AND YOU ARE LEGALLY ABLE TO ENTER INTO A CONTRACT.
Elysium44 provides an online legal portal to give visitors a general understanding of the law, an automated software solution (the “Application”) to individuals who choose to prepare their own legal documents.
Elysium44 does not provide any legal advice in connection with the free or paid Services and those free or unpaid Services are not substitutes for the advice of a lawyer. The Services made available on the Site may not be suitable for you in your circumstance as no general advice or Services can fit every circumstance. It is thus your responsibility to take legal advice from a lawyer when using any Services on the Site. Elysium44 does not accept any liability for any losses incurred by you as a result of your use of the Services on the Site.
The legal information contained on the Site is not legal advice and is not guaranteed to be correct, complete, or up to date. Therefore, if you need legal advice on a specific issue, you should consult a lawyer.
Where Elysium44 assists you in relation to any advice on the laws of jurisdictions other than the UAE, any such advice is given based on the research conducted on the laws of such jurisdictions. On a case-by-case basis, on your specific request, Elysium44 can procure legal advice from lawyers in relevant jurisdictions. The relevant fee/cost shall be payable by you in advance.
Elysium44 strives to keep its legal documents accurate, current, and up to date. However, because the law changes rapidly, Elysium44 cannot guarantee that all the information on the Site or the legal documents are completely up to date.
From time to time, Elysium44 may perform certain lawyer access services and introduce our visitors to lawyers through various methods. At no time is a lawyer-client relationship fostered or created with Elysium44 through the performance of any such services.
This Site and the Services are not intended to create any lawyer-client relationship, and your use of this Site does not and will not create a lawyer-client relationship between you and Elysium44. You will be representing yourself in any activity you undertake through the Site. A lawyer-client relationship will only be created when you are advised by a Elysium44 lawyer on any specific issue.
In connection with any Services, we do not review your answers for legal sufficiency, and we do not accept any responsibility for any incomplete or incorrect information provided by you in connection with the paid Services.
In the event you wish to disengage our services obtained for any mainland, free zone, and/or offshore company at any stage, you will be required to pay a fee for the issuance of the No-Objection Certificate (NOC) for such cause.
Elysium44 respects your privacy and permits you to control the treatment of your personal information. A complete statement of Elysium44´s current Privacy Policy can be found in our Privacy Policy. Elysium44´s Privacy Policy is expressly incorporated into these Terms by reference.
When you open an account to use or access certain portions of the Site or the Services, you must provide complete and accurate information as requested on the registration form. You will also be asked to provide a username and password. You are entirely responsible for maintaining the confidentiality of your password. You may not use a third party´s account, username, or password at any time. You agree to notify Elysium44 immediately of any unauthorized use of your account, username, or password. Elysium44 shall not be liable for any losses you incur because of someone else´s use of your account or password, either with or without your knowledge. You may be held liable for any losses incurred by Elysium44, our affiliates, officers, directors, employees, consultants, agents, and representatives due to someone else´s use of your account or password.
This Site and Application are owned and operated by Elysium44. All right, title and interest in and to the materials provided on this Site and Application, including but not limited to information, documents, logos, graphics, sounds and images (the “Materials”) are owned either by Elysium44 or by our respective third-party authors, developers, or vendors (the “Third Party Providers”).
This Site may contain links to websites controlled by parties other than Elysium44 (each a “Third Party Site”). Elysium44 works with several partners and affiliates whose sites are linked with Elysium44. Elysium44 may also provide links to other citations or resources with whom it is not affiliated. Elysium44 is not responsible for and does not endorse or accept any responsibility for the availability, contents, products, services or use of any Third-Party Site, any website accessed from a Third-Party Site or any changes or updates to such sites. Elysium44 makes no guarantees about the content or quality of the products or services provided by such sites.
Elysium44 grants you a limited, personal, non-exclusive, non-transferable license to use our free or paid legal documents and agreements forms (the “Legal Documents”) for your own personal. Except as otherwise provided, you acknowledge and agree that you have no right to modify, edit, copy, reproduce, create derivative works of, reverse engineer, alter, enhance or in any way exploit any of the Forms in any manner, except for modifications in filling out the Legal Documents for your authorized use. Any unauthorized use of any Legal Documents contained on this Site or Application may violate copyright laws, trademark laws, laws of privacy and publicity and communications regulations and statutes.
By purchasing or downloading legal documents, you agree that such documents may only be used by you for your personal use and may not be sold or redistributed without the express written consent of Elysium44.
At various locations on the Site or through the Application, Elysium44 may permit visitors to post ratings, reviews, comments, and other content (the “User Content”). Contributions to, access to and use of the User Content is subject to this paragraph and the other terms and conditions of these Terms. Elysium44 is not the publisher or author of the User Content. Elysium44 takes no responsibility and assumes no liability for any content posted by you or any third party.
Although we cannot make an absolute guarantee of system security, Elysium44 takes reasonable steps to maintain security. If you have reason to believe system security has been breached, contact us for help.
If Elysium44´s technical staff finds that files or processes belonging to a member pose a threat to the proper technical operation of the system or to the security of other members, Elysium44 reserves the right to delete those files or to stop those processes. If the Elysium44 technical staff suspects a username is being used by someone who is not authorized by the proper user, Elysium44 may temporarily disable that user´s access in order to preserve system security. In all such cases, Elysium44 will contact the member as soon as feasible.
Elysium44 has the right (but not the obligation), in our sole and absolute discretion, to edit, redact, remove, re-categorize to a more appropriate location, or otherwise change any User Content.
THE SITE, APPLICATION, AND ALL MATERIALS, DOCUMENTS OR FORMS PROVIDED ON OR THROUGH YOUR USE OF THE SITE OR APPLICATION ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. ELYSIUM44 MAKES NO WARRANTY THAT: (A) THE SITE, APPLICATION, OR THE MATERIALS WILL MEET YOUR REQUIREMENTS; (B) THE SITE, APPLICATION, OR THE MATERIALS WILL BE AVAILABLE ON AN UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE BASIS; (C) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SITE, APPLICATION, OR ANY MATERIALS OFFERED THROUGH THE SITE OR APPLICATION, WILL BE ACCURATE OR RELIABLE; OR (D) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SITE, APPLICATION, OR IN RELIANCE ON THE MATERIALS WILL MEET YOUR EXPECTATIONS.
OBTAINING ANY MATERIALS THROUGH THE USE OF THE SITE OR APPLICATIONS IS DONE AT YOUR OWN DISCRETION AND AT YOUR OWN RISK. ELYSIUM44 SHALL HAVE NO RESPONSIBILITY FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY CONTENT, MATERIALS, INFORMATION OR SOFTWARE.
EXCEPT AS PROHIBITED BY LAW, YOU WILL HOLD ELYSIUM44 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS HARMLESS FOR ANY INDIRECT, PUNITIVE, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGE, HOWEVER IT ARISES (INCLUDING LAWYERS’ FEES AND ALL RELATED COSTS AND EXPENSES OF LITIGATION AND ARBITRATION, OR AT TRIAL OR ON APPEAL, IF ANY, WHETHER OR NOT LITIGATION OR ARBITRATION IS INSTITUTED), WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE, OR OTHER TORTIOUS ACTION, OR ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, INCLUDING WITHOUT LIMITATION ANY CLAIM FOR PERSONAL INJURY OR PROPERTY DAMAGE, ARISING FROM THESE TERMS AND ANY VIOLATION BY YOU OF ANY LAWS, STATUTES, RULES, OR REGULATIONS, EVEN IF ELYSIUM44 HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF ELYSIUM44, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE PRODUCTS AND/OR SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES.
When accessing Elysium44 or using the Elysium44 legal document preparation Service, you agree to obey the law and you agree to respect the intellectual property rights of others. Your use of the Service and the Site is at all times governed by and subject to laws regarding copyright, trademark, and other intellectual property ownership.
The site is made available for your personal use on your own behalf.
Minors are not eligible to use the Site or Application and we ask that they do not submit any personal information to us.
By using this Site or any Applications, you expressly agree that your rights and obligations shall be governed by and interpreted in accordance with the laws of the United Arab Emirates.
Most client concerns can be resolved quickly and to the client’s satisfaction by contacting us. In the unlikely event that the Elysium44 Customer Care is unable to resolve your complaint to your satisfaction (or if Elysium44 has not been able to resolve a dispute it has with you after attempting to do so informally), we each agree to resolve those disputes through binding arbitration.
Any dispute arising out of the formation, performance, interpretation, nullification, termination, or invalidation of these Terms contract or arising therefrom or related thereto in any manner whatsoever, shall be settled by arbitration in accordance with the provisions set forth under the DIAC Arbitration Rules (“the Rules”), by one arbitrator appointed in compliance with the Rules.
Elysium44, Elysium44.ae, the coloured document logo, all images and text, and all page headers, custom graphics and button icons are service marks, trademarks and/or trade dress of Elysium44.
You acknowledge that Elysium44 reserves the right to refuse service to anyone and to cancel user access at any time.
If Elysium44 encounters evidence of suspicious activity in connection with my account, including, but not limited to, evidence that my account is being used by someone who is not authorized to do so, I acknowledge that Elysium44, in its sole discretion, may opt to temporarily disable my account.
To use Elysium44 services, I must obtain access to the World Wide Web, either directly or through devices that access web-based content and pay any service fees associated with such access. I am responsible for providing all equipment necessary to make such connection to the World Wide Web, including a computer and Internet access. Access to certain Elysium44 services may be limited or delayed based on problems inherent in the use of Internet and electronic communications. I understand that Elysium44 is not responsible for delays, delivery failures, or other damage resulting from such problems.
Elysium44 shall not be considered in breach of or default under these Terms or any contract with me, and shall not be liable to me for any cessation, interruption, or delay in the performance of its obligations hereunder by reason of earthquake, flood, fire, storm, lightning, drought, landslide, hurricane, cyclone, typhoon, tornado, natural disaster, act of God or the public enemy, epidemic, famine or plague, action of a court or public authority, change in law, explosion, war, terrorism, armed conflict, labour strike, lockout, boycott or similar event beyond our reasonable control, whether foreseen or unforeseen (each a “Force Majeure Event”). If a Force Majeure Event continues for more than 60 days in the aggregate, Elysium44 may immediately terminate these Terms and shall have no liability to me for or because of any such termination.
Tax and Government Fee
All fee and other prices (“Our Fee”) mentioned on this Site are exclusive of value added taxes, any government fee, and other taxes etc. (the “Tax and Government Fee”) that may be payable in connection with the provision of the Services. The Tax and Government Fee shall be payable by you in addition to Our Fee.

Legal Retainer Plans (“Legal Plans”)
We reserve the right to accept or refuse membership in our discretion. You may not transfer or assign your Legal Plan or these benefits.
A subscription to a Legal Plan provides the following additional benefits (collectively, the “Plan Benefits”):
Any consultations with Elysium44 or the relevant participating firm appointed by Elysium44 (collectively, the “Firm”), during normal business hours, in relation to corporate or commercial law matters, of up to the number of hours per month for which the legal plan is purchased and paid for by you. The consultations under the Legal Plan shall not include any specialist advice on any of tax, criminal, traffic, employment, banking, insurance, litigation, shipping, and intellectual property law related matters.
The following items and matters are specifically excluded from the Legal Plans, and are not to be considered or treated as Plan Benefits:
(i) Any action that directly or indirectly involves Elysium44 or any of its affiliates, directors, agents, or employees.
(ii) Any action that directly or indirectly involves any Firm providing legal services under the Legal Plans; provided, however, that a Firm may, at its sole discretion and risk, represent a Plan Member in a matter in which another affiliated Firm is representing another party as legal counsel.
(iii) For employer-sponsored Legal Plans, any action by a Plan Member of such program that directly or indirectly involves his or her employer sponsor.
(iv) Any adversarial action by a Plan Member that directly or indirectly involves any other Plan Member in any Plan Group.
(v) Any action based on acts or occurrences that are alleged to have occurred or conditions that were reasonably anticipated or foreseeable before the Plan Member´s enrolment that did or may give rise to a lawsuit by or against such Plan Member; provided, however, that the Firm may, in its sole discretion and at its own risk, disregard this exclusion.
(vi) Any action that resulted in the prior recruitment or retention by the Plan Member of another attorney; provided, however, that the Firm may, in its sole discretion and at its sole risk, disregard this exclusion.
(vii) Any matter involving the laws of jurisdictions outside of the United Arab Emirates.
(viii) Any appeal to an appellate court (i.e., not a trial court); provided, however, that the Firm may, in its sole discretion and at its sole risk, disregard this exclusion.
(ix) Any matter that, in the Firm´s opinion, is frivolous in nature or objective; or
(x) Any case matter or requested service that is determined by the Firm to lack sufficient merit to warrant pursuit, or that the Firm decides has been raised an inordinate or unreasonable number of times without a change in circumstances.
The Legal Plans offered through Elysium44 are not contracts of insurance or indemnification insurance plans. Elysium44 is not an insurance company and does not guarantee legal representation in every situation. The Legal Plans provide Elysium44´s clients with access to free and discounted legal services from member Firms. Elysium44 does not reimburse or indemnify any Plan Member or pay any Firm for lawyer fees or expenses.
General Practices
You acknowledge that Elysium44 may establish general practices and limits concerning use of its Legal Plans, including without limitation the maximum number of complimentary attorney consultations you may receive in each period of time related to one or all subjects.
Right to Change Practices
You acknowledge that Elysium44 reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.
Responsibility for Misuse
You are responsible for all expenses incurred or other actions that may occur through your use of a Legal Plan. You must immediately alert us of any fraudulent, unauthorized, illegal, or suspicious use of a Legal Plan, or any other breach of security or unauthorized or illegal activity that you reasonably suspect.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the legal authority to bind such entity to these terms, in which case the terms “you” or “your” shall refer to such entity. If you do not have such authority or if you do not agree with these Terms, you may not sign up for or use any Legal Plan. If after your purchase we find that you do not have authority to bind the entity for which you ordered, you will be personally responsible for the obligations in these Terms and the order you placed, including without limitation, the payment obligations. We are not liable for any loss or damage resulting from our reliance on any instruction, notice, document, or communication, reasonably believed by us to be genuine and originating from an authorized representative of your company. If there is reasonable doubt about the authenticity of any such instruction, notice, document, or communication, we may, but are not obliged to, require additional authentication from you.
Legal Plan Membership Fees
You will be charged in accordance with the billing terms in effect at the time of your initial purchase. For any Legal Plan you purchase that is charged in full upon purchase, you agree that for each renewal term for such Legal Plan, the amount due for the next term will be due and immediately payable in full as of the first day of that renewed term. For each Legal Plan, your charge remains for each term no matter if you access the Site during that term. In other words, EVEN IF YOU DO NOT USE THE LEGAL PLAN BENEFITS, YOU WILL BE RESPONSIBLE FOR ANY SUBSCRIPTION FEES UNTIL YOU CANCEL YOUR SUBSCRIPTION OR IT IS OTHERWISE TERMINATED.
Billing
To allow payment for the initial term of a Legal Plan, valid credit card information is due at the time of purchase.
If you have purchased an automatic renewing plan from Elysium44, your Legal Plan subscription will renew automatically at the end of the initial term (the “Billing Date”) and at the end of each term thereafter unless and until you give notice of your intention to terminate your Legal Plan subscription pursuant to the terms of these Terms. If you do not give us notice of such intention, your credit card will be charged for the renewal term of your Legal Plan subscription on your Billing Date.
Elysium44 may increase its fees for any Legal Plan subscription effective the first day of a renewal term by giving you notice of the new fees at least thirty (30) days before the beginning of the renewal term. If you do not cancel your subscription pursuant to Section 10, you shall be deemed to have accepted the new fee for that renewal term and any subsequent renewal terms (unless the fees are increased in the same manner for a subsequent renewal term). Reductions in fees become effective on the next renewal term without any pro rata for the period covered under the prior fee schedule.
